Employer Sponsored Visas

This type of visa allows employers to sponsor suitably skilled workers to fill positions where they are unable to find suitably skilled workers in Australia. There are mainly three types of visas, short-term, medium and long-term and permanent.

Note: all three visas have Labour Agreement stream, which is introduced below:

Labour Agreement stream

The Labour Agreement stream might be for you if you currently work, or will work, for an employer who is party to a labour agreement.

To apply under this stream, you 

  • must currently work, or will work, for your employer under a labour agreement.
  • must have a suitable English language skills, experience, skills and other attributes for the position.
  • may be asked to get a skills assessment that shows you have the skills to work in the position. Do not get an assessment unless Department of Home Affairs ask you.
  • must be nominated by an Australian employer whose business is party to a labour agreement.

To apply under this stream, your employers

  • must currently have a labour agreement in place with the Australian Government and have met any nomination requirements specified in the agreement.
  • The occupation you are nominating must be listed in the labour agreement.

Temporary Skill Shortage Visa TTS (subclass 482) – Temporary visa

The TSS visa comprises of a Short-Term stream of 2 years, and a Medium-Term stream of up to 4 years. Hong Kong passport holders may stay up to 5 years.

Short-Term Stream

You can work in Australia for 2 years or up to 4 years if an International Trade Obligation applies.

Medium-Term Stream

You can work in Australia for up to 4 years or up to 5 years if you are a Hong Kong passport holder; Eligible TSS visa holders whose occupation appears on the Regional Occupation List will be able to apply through the Employer Nomination Scheme, Temporary Residence Transition stream. This pathway will only be accessible for two years from its commencement on 1 July 2022.

To apply for this visa 

  • Other than you must be nominated to work in an occupation on the list of eligible short-term skilled occupations or medium and long-term skilled occupations.
  • You need to have at least 2 years relevant work experience in your nominated occupation or a related field.
  •  have a relevant skills assessment if this is required for your occupation.
  •  work only for your sponsor or associated entity unless you are exempted.
  • meet minimum standards of English language proficiency unless you are exempted.

Skilled Employer Sponsored Regional (Provisional) visa 494

With visa 494, you can stay in Austrian five years. During these five years, if you meet all criteria of visa 191, you can apply for permanent residence visa for next step.

Employer Sponsored Stream

With this stream, your employer can nominate you for any type of work as long as it’s listed in the skilled occupation list.

To apply for this visa, you

  • must be nominated by an employer whose business is lawfully operation in Australia.
  • must be employed to work in the nominated occupation and in a position within the sponsoring business or an associated entity of that business, located in a designated regional area of Australia.
  • must demonstrate that you have the skills, qualifications, and work experience necessary to perform the nominated occupation.
  • must undertake a skills assessment to demonstrate this.

To apply for this visa, your employer

  • must be a standard business sponsor (approved by the Department of Home Affairs, valid for 5 years from approval).
  • must applied to become a standard business sponsor.
  • Nominated the skilled worker for an eligible occupation and is in skilled occupation list.

Employer Nomination Scheme visa 186

This visa lets skilled workers, who are nominated by their employer, live and work in Australia permanently.

Direct Entry stream

This stream allows you to live, work and study in Australia indefinitely; sponsor eligible family members to come to Australia; apply for Australian citizenship, if eligible

To apply under this stream, you

  • must have an occupation that is on the list of eligible skilled occupations.
  • have at least 3 years relevant work experience unless you are exempt.
  • have a positive skills assessment, unless you are exempt.

To apply under this stream, your employer

  • must actively and lawfully operating a business in Australia.
  • can afford to pay the salary of a sponsored person for two years from the date of a Subclass 186 visa grant.
  • the position is full-time and available for two years.
  • the nomination occupation is on the Medium Long-term List.
  • must be paid the “market rate” salary.
  • needs to demonstrate why there is a genuine need for that position in their business.

Temporary Residence Transition stream 

To apply under this stream, you

  • must hold a subclass 457, TSS 482 visa or related Bridging visa A, B or C.
  • have worked for your employer for at least 2 years full time while holding a subclass 457 or TSS 482 visa.
  • have been nominated by an Australian employer whose nomination was approved in the 6 months before you apply.
  • eligible TSS-short term stream visa holders, and those visa holders with an occupation on the Regional Occupation List will be able to apply through the TRT stream. The pathway will be accessible for two years from its commencement on 1 July 2022.

To apply under this stream, your employers

  • must demonstrate they have an operating business and can afford to continue to pay the salary of the visa applicant.
  • the job or position being nominated is consistent with the position held while on the subclass 457 or TSS 482 visa.
  • the position must continue to be available to the employee for at least two years once the visa is granted.
  • the terms and conditions including the salary of the position must be market related.
